Malpractice Medical malpractice cases arise when a doctor, chiropractor, pharmacist, hospital employee or nurse, fails to use reasonable care and skill expected under the circumstances. Medical malpractice comes about because of: (1) improper treatment, (2) failure to remove a surgical instrument or sponge, (3) misdiagnosis, (4) a failure to obtain proper consent, or, (5) abandoning a patient. Medical malpractice does not arise because the patient did not get well or encountered complications. There must be a failure to use reasonable care under the circumstances. BurmanLaw accepts medical malpractice cases where the injury is directly caused by the real and actual fault of a doctor, chiropractor, pharmacist, hospital employee or nurse. Further, the medical malpractice must result in death or permanent pain and injury. Contact me if you have questions. I promise to listen and give you honest answers. |
